Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 3278 of 2009, under Sections 323, 506, 342 & 384 IPC read with Section7 Criminal Law Amendment Act, police station Kotwali Nagar, district Sultanpur.
We have gone through the contents of the FIR and other documents annexed hereto.
From bare reading of the FIR it cannot be said that no cognizable offence under said sections is made out, as such, the FIR cannot be quashed. However, seeing the manner in which this FIR has seen light of the day, we dispose of the writ petition with direction that the petitioners shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against them in the shape of report under 173 CrPC, provided they cooperate with the investigation, which shall go on.
