JUDGMENT / ORDER

(Order of the Court was made by M.CHOCKALINGAM, J.) Invoking the Writ jurisdiction of this Court, the petitioner, namely, Saguru Banu, has filed this petition for issuance of a Writ of Habeas Corpus for production of her son, namely, Nazir, aged about 37 years.
2. The affidavit filed in support of the petition is perused. The Court heard the learned counsel for the petitioner. The gist of the case of the petitioner is that her son, namely, Nazir, an auto driver by profession, was found missing from 28.11.2008; that a complaint was given by her daughter-in-law on 02.12.2008 before the Maduravoyal Police station, the 2nd respondent; that a case was registered in Crime No.772 of 2008 on 02.12.2008 as 'man missing'; but the respondents have not taken any steps to trace out her son and that the investigation is pending.
3. Now, the learned Additional Public Prosecutor would submit that a case was registered and on investigation, steps are being taken to secure the son of the petitioner.
4. As could be seen from the averments in the affidavit filed in support of the petition, there is no allegation made against any person. It is also brought to the notice of the Court that he is a sane person and is not indulged in any other illegal activities. Under such circumstances, the Court is of the considered opinion that instead of keeping the matter pending, a direction is given to the respondents police to take further steps expeditiously, secure him and produce before the Court concerned and also file a report thereon.
With the above direction, the habeas corpus petition is disposed of.
