Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 1189 of 2009, under Sections 379, 504, 506 & 427 IPC read with Section 3 (1)
(x) SC/ST Act, police station Sidhauli, district Sitapur. We have gone through the contents of the FIR and other documents annexed hereto.
It comes out that the complainant, who happens to be Gram Pradhan, has lodged this FIR alleging therein that the petitioners are interfering and interpreting the public work being conducted in village Mukimpur, which comes under the gram-sabha of the complainant. Since the FIR discloses commission of cognizable offence, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed. Order Date :- 13.1.2010 Pradeep/-
