Heard learned counsel for the revisionist and learned A.G.A. for the State.
The present criminal revision has been filed to set aside the judgment and order dated 19.4.2010 passed by the Special Judge (S.C./S.T. Act) Additional Sessions Judge, Ghaziabad in Crl. Misc. Appeal No.211 of 2007 as well as the judgment and order dated 12.7.2007 passed by the Special Judicial Magistrate (CBI) Ghaziabad in Crl. Case No.992 of 2005 arising out of Case Crime No.31 of 1999 under Section 411 IPC, P.S. Linkroad, District Ghaziabad.
Learned counsel for the applicants submits that applicant has been falsely implicated in this case. There is no public witness though recovery is claimed to have been made from a public place. It is further stated that the applicant is in jail since 3.1.2018.
List for hearing after two months.
Considering the facts and circumstances of the case, let the revisionist Sageer be released on bail on his furnishing personal bond and two local sureties each in the like amount to the satisfaction of the Court concerned below in the aforesaid cases.
Further, half of the fine imposed shall be deposited by of the applicant within one month from his release.
As soon as personal and surety bonds are furnished, photocopies of the same are directed to be transmitted to this Court forthwith by the concerned court to be kept on record.
