Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Sri Ashok Singh, learned counsel appearing for the first respondent.
The petitioner claims to be the son of ex-employee working on the post of Sweeper with the Uttar Pradesh National Cadet Corps (NCC), Moradabad. He died-in-harness on 19 August 2017. Petitioner claims compassionate appointment under the U.P. Recruitment of Dependants of Government Servants (Dying In Harness) Rules, 1974 (for short the "Rules, 1974") as amended in 2014. In paragraph no.17 of the writ petition, it has been categorically stated that the mother of the petitioner is a government employee.
On specific query, learned counsel for the petitioner is unable to point out from the Rules, 1974 that he is eligible of being considered for compassionate appointment when, the spouce of the ex-employee is a government servant.
In view thereof, the writ petition being devoid of merit is, accordingly, dismissed.
