The case of the petitioner is that his house is situated over Nazul Plot No. 49, Amarnath Jha Marg and the layout of the same has been carved as sub-divided Nazul Plot No. 49/1. It is stated that in the said plot 11 residential houses have been constructed and there is a 20 feet wide road within Nazul Plot No. 49/1 which connects main road in the north to C.Y. Chintamani Road and in the west to Amarnath Jha Marg. However, the Nagar Nigam has developed a road within the residential colony without making any provision for drainage of the rain water and other basic facilities, and due to the uneven and defective development of the passage, residents of the colony are facing great inconvenience and hardship.
For the redressal of his grievance the petitioner has moved a representation before respondent no. 4, copy whereof is annexure-2 to the writ petition.
We have heard learned counsel for the petitioner and learned Standing Counsel.
We are of the view that the ends of justice would be met by issuing a direction upon respondent no. 4 to make an endeavour to redress the grievance of the petitioner as early as possible preferably within a period of four months from the date of communication of this order.
Needless to say that we have not expressed our opinion on the merits of the case. The authority concerned shall pass the order independently and in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
