JUDGMENT / ORDER

The petitioners are concerned with the denial of participation in the Viva and submission of the main project in the M.Tech Course. Admittedly, they have completed the M.Tech course, in which the 1st petitioner lost two subjects and the 2nd petitioner lost one subject in the 2nd semester and the University had not conducted the supplementary examination for the 2nd semester. This Court had been granting interim orders to persons, who had applied for the 2nd semester supplementary examination and participated in the same but whose results were not published, to appear provisionally in the 4th semester examination. This was only by reason of the delay in scheduling the supplementary examinations. 2. In the present case, the petitioners have not even appeared for the supplementary examinations; though by reason of the delay caused in the scheduling WP(C).29509/14 2 of examinations. When the petitioners seek for is a participation in the 4th semester examination even before appearance in the 2nd semester supplementary examinations. True, the delay is of the University; but it has to be noticed that the petitioners failed in the regular examinations. Further the petitioners have not approached this Court within the time stipulated for applying to the 4th semester examinations. The learned Standing Counsel submits that the last date is over and the date for making application with fine and even with superfine is also over. There can be hence, no provisional order granted for participation in the 4th semester Viva examination.
The writ petition stands dismissed.
