In spite of time having been allowed on 9.9.2013, no counter affidavit on delay condonation application has been filed.
The cause shown is sufficient.
The delay is condoned.
After assigning a regular number to this appeal, list in the next cause list along with Connected Criminal appeal no. 448 of 2009 for admission and consideration for prayer of bail.
In the meantime learned A.G.A. may file written objection.
