JUDGMENT / ORDER

Petitioners are accused 1 to 4 in Crime No. 1542 of 2014 of Karunagappally Police Station for offences punishable under Sections 143, 147, 148, 323, 324, 307 and 427 read with Section 149 of the Indian Penal Code, apprehend arrest and have filed the application. 2. Learned Public Prosecutor has opposed the application.
3. It is submitted that on 05.05.2014 at about 9.10 p.m., the petitioners attacked the de facto complainant and his brother with iron rod and iron pipe and voluntarily caused hurt to them.
4. Learned counsel submitted that the allegations are not true. De facto complainant and others attacked the first petitioner for which the police registered a case. This case is registered as a counter blast.
5. I have gone through the CD file and find from the wound certificate that one of the injured suffered lacerated wound, 10 x 3 x 1 cm over right parieto frontal bone. Having regard to B.A. No. 3783 of 2014 2 nature of the allegations made and the investigation required to be done, request for pre arrest bail cannot be allowed. It is directed that in case the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
This application is disposed of as above.
