Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed by the applicant seeking direction to the court below to return the drafts deposited by the applicant in Case No. 1631 of 2015.
It has been submitted by the learned counsel for the applicant that applicant made an application before A.C.J.M.-6, Meerut in Case No. 1631 of 2015 that his daughter-in-law, who was contesting a case under Section 12 of Domestic Violence Act against him, has failed to appear before the court as a result of which case has been dismissed for want of prosecution. Therefore the amount of maintenance deposited by way of Demand Draft may be returned to the applicant. Court below has not accepted such application.
Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to accept the application of the applicant and pass appropriate order thereon within a period of one month from the date of production of a certified copy of this order, if there is no other legal impediment.
