Heard learned counsel for the applicant and learned A.G.A for the State.
The present application under Section 482 Cr.P.C. has been filed for direction to the Additional Chief Judicial Magistratre, Court No. VI, Meerut to decide the Case No. 1646 of 2015 (Mohammad Shaid Khan Vs. State of U.P.) arising out of Case Crime No. 159 of 2011, under Sections 498-A, 376, 511, 323, 504, 506, 307, IPC and 3/4 D.P. Act, P.S. Lisari Gate, District Meerut, pending in the court of A.C.J.M, 6th, Meerut.
This is the third application of the applicant praying for expediting the trial of Case No. 1646 of 2015 under Sections 498-A, 376, 511, 323, 504, 506, 307, IPC and 3/4 D.P. Act, P.S. Lisari Gate, District Meerut.
The applicant has earlier approached this Court by way of application under Section 482 No. 36651 of 2016 and 20632 of 2018, wherein the court below was directed to conclude the trial without granting unnecessary adjournment.
It has been submitted that despite the orders aforesaid, the trial has not yet been concluded.
This application is disposed of with a direction to the applicant to bring to the notice to the trial court the aforesaid orders passed by this Court and a direction to the trial court to expedite the trial. In case the prosecution is unable to produce the evidence the trial court is at liberty to put them to notice and close the evidence of the prosecution and proceed with the trial.
The trial court is not expected to wait endlessly for the prosecution and speedy trial is the right of every accused.
