JUDGMENT / ORDER

Heard learned Sr. Counsel Mr. P.M. Thakkar for M/s. Thakkar Associates for the applicant, learned APP Mr. HL Jani for respondent No.1-State and learned counsel Mr. Vijay Patel for HL Patel Advocates for respondent No. 2.
2. An affidavit has been filed by respondent No. 2. It is stated in the affidavit as well as by learned counsel Mr. Vijay Patel that respondent No. 2 restricts the complaint qua the offence under sec. 506(2) of IPC and not for other offences and therefore it will be open for I.O. to proceed with the investigation qua the offence under sec. 506(2) of IPC and take appropriate steps.
3. In the facts and circumstances and in view of the contentions raised as well as the affidavit filed by respondent No.2, the matter requires a detailed hearing and the following order is passed:
4. Rule returnable on 20.9.2012. Ad-interim relief that no coercive steps may be taken qua the applicant shall continue till further orders.
