Heard learned counsel for the petitioner; the learned Standing Counsel for the respondent no.1; and Sri Narendra Kumar Tiwari for the respondent nos. 2 and 3.
It appears that the fourth respondent (Lakchhi Devi) has applied for an electricity in connection with which an estimate has been prepared and the transmission line is to be mounted on poles installed on the chak-road.
Aggrieved therewith the petitioner has moved an application before the Superintendent Engineer on 02.11.2020. The petitioner seeks a direction upon the respondents to consider its grievance.
We have perused the application of the petitioner dated 02.11.2020. From which, it does not appear that petitioner's land is being affected from the electricity supply line to be drawn for supply of electricity to the fourth respondent.
We, therefore, decline the prayer of the petitioner. But, if the electricity pole or line is to be pass over the petitioner's land or property then the petitioner would be at liberty to take recourse to the provisions of Works of Licensees Rule, 2006 and make representation in respect of his grievance to the District Magistrate of the district concerned.
