Heard learned counsel for the accused applicant, learned counsel for the State and learned counsel for the complainant.
Perused the F.I.R. and other relevant papers filed in support of the bail application.
Submission of the learned counsel for the accused applicant is that the co-accused Shiv Bahadur Singh has already been granted bail by this court vide this Court's order dated 20.08.2009 passed in Crl. Misc. No. 4603. It is submitted by the learned counsel that the case of the applicant is at par with co-accused Shiv Bahadur Singh. The accused applicant is in jail since 05.10.2010 as averred in para 12 and has no criminal history as averred in para 16 of the bail application.
Considering the facts and circumstances of the case and without expressing any view on the merits of the case, let the accused applicant be enlarged on bail in Case Crime No. 496 of 2009, u/Ss 170, 419, 420, 406 I.P.C. and 7/8 Prevention of Corruption Act, P.S. Kotwali Dehat, District-Hardoi on his furnishing a personal bond and two local and reliable sureties each in the like amount to the satisfaction of the court concerned/Remand Magistrate.
