Heard learned counsel for revisionists and learned A.G.A. for the State.
The order dated 8.10.2009 passed by Judicial Magistrate, Mawana, District Meerut, in complaint case no.232 of 2009 summoning revisionists under Sections 420, 406, 323, 504, 506 I.P.C. Police Station Mawana, District Meerut, is impugned in the instant revision.
Submission is that opposite party no.2 and accused/revisionists are of one and same family. The instant complaint has been registered against brother, mother and other family members. It is a case of no injury.
Issue notice to opposite party no.2 returnable at an early date.
Counter affidavit may be filed within three weeks from the date of receipt of notice. Rejoinder affidavit may be filed within three weeks thereafter.
List immediately on expiry of the aforesaid period.
Till the next date of listing, operation of the impugned order dated 8.10.2009 passed by Judicial Magistrate, Mawana, District Meerut in complaint case no.232 of 2009 Yusuf Vs. Saeed Ahamad and others shall remain stayed.
