Heard learned counsel for the petitioner, and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"(i) issue, a writ, order or direction in the nature of mandamus commanding the Trial Court/ Tehsildar, Phoolpur, District Azamgarh (Respondent NO. 2) to decide the proceeding of Mutation Case 1452 of 2012-13 and Computerized NO.T201315631929 (dated 17.7.2013) Sadruddin Versus Imteyaz Ahamad, Under Section 34/35 of U.P. Revenue Code 2006, Mauja Mahul, Pargana Mahul, Tehsil Phoolpur, District Azamgarh within stipulated period as directed by this Hon'ble Court."
The petitioner is aggrieved on account of pendency of a mutation application filed in July, 2013 which has not been decided till date.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Tehsildar, Phoolpur, Azamgarh to consider and decide the mutation application expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him.
