Heard Mr. Sanjay Kumar Dwivedi, learned counsel for the applicants and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed challenging the order dated 03.02.2018 passed by the learned Additional Chief Judicial Magistrate, Mathura, Court no. 2 in Complaint Case No. 2161 of 2017 (Bhoora Vs. Sadiq and others) P.S.- Farah District-Mathura whereby an application for discharge in terms of Section 245 (2) Cr.P.C. filed by the applicants has been rejected.
Having perused the impugned summoning order dated 03.02.2018, the Court does not find any illegality in the same. It is the admitted position that the applicants have not appeared before the court below. Without putting in appearance in the pending criminal proceedings before the court below, the application seeking discharge was filed. The court below has not committed any illegality in rejecting the discharge application. Consequently, the present application fails and is hereby dismissed.
