JUDGMENT / ORDER

Heard learned counsel for the petitioner and Ms. Deepshikha, leaned Addl. Chief Standing Counsel for the State-Respondents.
The present writ petition has been filed under Article 226 of the Constitution of India seeking relief to the effect that a direction be issued to the opposite party No.2-Sub-Registrar, Registration Office, Akbarpur, District- Ambedkarnagar to register the will deed in accordance with law within the time framed by this Court.
In view of the order proposed to be passed, notice to opposite party No. 3 is dispense with.
Facts, in brief, of the present case are to the effect that the petitioner moved an application dated 16.12.2017 under Section 40 of the Registration Act registered as Case No. 1/2018 before the opposite party No. 2 for registration of a will deed dated 22.11.2017 executed by the late Mahant Ram Nath Das in favour of the petitioner.
Learned counsel for the petitioner submits that the application dated 16.12.2017 has not been disposed of till date.
The petitioner has also annexed the copy of the application as well as the copy of the order-sheet of the proceedings before the opposite party No. 2 on the application for registration of will deed moved under Section 40 of the Registration Act, which is registered as Case No. 1/2018.
For the prayers sought in the writ petition, learned counsel for the State-Respondents has no serious objection.
In view of the above, the present writ petition is disposed of with a direction to the opposite party No.2-Sub-Registrar, Registration Office, Akbarpur, District- Ambedkarnagar to make an endeavour to dispose of the application of the petitioner moved under Section 40 of the Registration Act, which is registered as Case No. 1/2018, expeditiously, say within a period of six months, if possible, from the date of production of certified copy of this order and while deciding the application, the opposite party No. 2 shall provide the proper opportunity of hearing to the party concerned, as per Law.
