Sadhu vs Rajkot

High Court Of Gujarat|30 March, 2012

JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after going through the materials on record, we find that during pendency of the Special Civil Application, the petitioner has already paid the principal amount of dues. Now the only dispute is as regards the amount of interest payable by the petitioner.
In such circumstances, we dispose of this application by directing the Corporation not to take any coercive step for realisation of the amount of interest and the said amount will abide by the final decision in the Special Civil Application. It is needless to mention that the payment made by the petitioner during the pendency of the application is without prejudice to its rights and contentions in the main Special Civil Application.
The application accordingly stands disposed of.
