Heard Shri Lalji Yadav, learned counsel for the petitioner, Shri A.K. Verma, learned counsel for the respondent No.2 and the learned standing counsel for the respondents No.1, 3, 5 and 6.
In this public interest litigation, a pray has been made by the writ petitioner to restrain the respondent No.7 from running brick kiln, which is situated at Village Ithua Sunderpur, Pargana Bidahar, Tehsil Alapur, District Ambedkar Nagar.
By way of supplementary affidavit dated 04.07.2019, learned counsel for the petitioner has drawn our attention to the closure order date 16.11.2018 passed by the U.P. Pollution Control Board.
In view of the aforesaid subsequent event, nothing survive in this writ petition because the closure order has already been passed by the U.P. Pollution Control Board and, therefore, we dismiss the writ petition as rendered infructuous.
With the aforesaid, the writ petition is dismissed as infructuous.
