Heard Sri R.K. Singh, learned counsel for the petitioner and learned Standing Counsel for respondent nos. 1 to 3. Notice need not to be issued to respondent no. 4, at this stage.
This writ petition has been filed with the following prayer:-
"i) Direct the respondent no. 3 to consider the claim of the petitioner 1/5 share of the property and agricultural land and name was mutated in revenue record. In view of the judgment dated 11.08.2020 passed by Supreme Court in case of Vineeta Sharma vs. Rakesh Sharma, and decided the case no. 202115060401524 and Case No. 2021115060401535 under Section 33(3) of U.P. Revenue Code-2006 (Sadhana vs. Manaraji) pending before the respondent no. 3 for disposal;"
It is contended that proceedings under Section 33(3) of the U.P. Revenue Code, 2006 for mutation in the revenue records which is pending consideration before respondent no. 3. The sole prayer is for early disposal of the the proceedings.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 3 to conclude the proceedings, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
