Heard learned counsel for the petitioner; learned Standing Counsel for the respondent no. 1 to 3; and Shri Suresh Singh, learned counsel for the respondent no. 5.
The instant petition seeks a direction upon the respondents to ensure that the fifth respondent, who happens to be mother of the petitioner, does not harass the petitioner and interfere in her peaceful life.
The petitioner has been produced by the learned counsel for the petitioner and the respondent no. 5, the mother of the petitioner has also been produced before us by the learned counsel for the respondent no. 5.
From the statement of the petitioner it appears that her mother had been pressurizing her to marry a particular person but the petitioner was not agreeable to such marriage and, therefore, her mother had been torturing and harassing her, as a consequence whereof, she had to take shelter at her Nanihal (maternal grand father's home) and had to change her place of living from one house of a friend to another.
The respondent no. 5, namely, Saroj Gupta, has stated before us that although the petitioner has attained the age of majority but she is not in a position to maintain herself and, therefore, she should be given in the custody of the respondent no. 5. She states that she will not harass the petitioner.
The petitioner is not agreeable to go with her mother.
As the petitioner is not agreeable to go with the respondent no. 5 and has expressed her apprehensions, we deem it appropriate to dispose off this petition by providing that in case an application is moved by the petitioner before the Senior Superintendent of Police, Prayagraj in respect of her safety and protection, the said application shall be accorded due consideration and appropriate action shall be taken against those who interfere in her life.
With the aforesaid observation/direction, the petition is disposed off.
