Heard Shri R.P. Mishra, learned counsel for the petitioner and the learned standing counsel for the respondents.
The petitioner is seeking quashing of the orders dated 15.5.2012, 28.5.2012 and 17.1.2013 arising out of proceedings under the Indian Stamp Act.
An application dated 20.3.2018 alongwith affidavit has been filed by the petitioner bringing on record the G.O. dated 10.1.2018 which provides that if the petitioner deposits the deficiency of stamp duty with interest within the time frame given with the token penalty of Rs.10/- then the penalty imposed by the stamp authorities shall stand waived. According to the petitioner he has already deposited Rs. 83,860/- of the deficiency of the stamp duty.
Learned counsel for the petitioner, therefore states that he may be permitted to approach the State Government for seeking the benefit of this G.O. which is stated to be available only in the months of January, February and March, 2018.
This writ petition is therefore disposed of with liberty to the petitioner to represent to the State Government to claim the benefit if available to him under the G.O. dated 10.1.2018 providing for Samadhan Yojna within 15 days from today and the respondent no.1 shall decide the petitioner's representation within two months from the date of receipt of the same.
The impugned orders shall be subject to any final order which may be passed by the State Government.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
