Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents 1 and 2; and perused the record.
The prayer in this petition is to command the respondents to ensure payment of the amount payable under the Mukhyamantri Kishan Evam Sarvahit Beema Yojna within a stipulated period.
The grievance of the petitioner is that the claim under the Mukhyamantri Kishan Sarvahit Beema Yojna has been arbitrarily rejected by the third respondent (Insurance Company) against which the petitioner has filed a representation before the District Magistrate, Jaunpur on which no decision has yet been taken.
Considering the nature of the prayer made in this petition, without expressing any opinion on the merits of the claim, we deem it appropriate to dispose off this petition by requiring the District Magistrate, Jaunpur to call for necessary report and take an appropriate decision on the claim of the petitioner in accordance with law and after giving opportunity of hearing to the insurance company, preferably, within a period of eight weeks from the date a copy of this order along with copy of any representation that may have been filed by the petitioner in respect of his grievance is filed in his office.
