Heard learned counsel for the applicant and Sri D.P.S. Chauhan, learned A.G.A along with Sri Mayanak Awasthi, Brief Holder appearing for the State.
By means of this application under Section 482 Cr.P.C, proceedings in pursuance of charge sheet dated 14.1.2014 against the applicants arising out of Case Crime No.1250 of 2013, under Sections 147, 148, 308, 325, 323, 504, 506 IPC, Police Station Sevrahi, District Kushinagar registered as Case No. 63 of 2015 of which congnizance was taken by the court below on 27.1.2015, are prayed to be stayed and charge sheet to be quashed.
Learned A.G.A at the outset pointed out that the applicants were named in the F.I.R and they have come before this Court after a period of almost four years seeking the relief as above and further, the order sheet of the court below has not been enclosed with the application, which would show the stage of proceedings in the court below.
I am inclined to agree with the objections raised by the learned A.G.A.
In view of above, I find no reason to interfere in the proceedings of the court below being highly belated and without any justifiable reason explaining the delay. Thus, the application is rejected.
