JUDGMENT / ORDER

Ramachandran Nair, J.
This appeal is from the judgment and decree in O.S.No.19 of 2001, by the plaintiff. The suit was one for specific performance of the agreement for sale, which was dismissed by the trial court. Pursuant to the reference of the matter for mediation, the matter has been settled and a copy of the agreement has been forwarded by the learned Mediator.
2. It is submitted by the learned counsel for the appellant that the 4th respondent is no more. She was the mother of the first defendant. The agreement has been signed by the first defendant and the dispute has been settled by payment of Rs.5,00,000/- (Rupees Five lakhs only) in full settlement of the claim. The learned counsel appearing for the parties before this Court, also signed the agreement today.
In the light of the above, this appeal is disposed of as settled. It is not necessary to implead anybody as legal representatives of the 4th respondent, who is no more. The R.F.A No.136 of 2008-B 2 terms and conditions of the agreement will form part of the judgment. The court fee paid on the Memorandum of Appeal will be refunded to the appellant. The parties will bear costs in the appeal.
