This petition has been filed with a prayer to quash the order dated 16.3.2013 passed by Sri K.P. Singh, Deputy Secretary, Government of U.P. in case crime No. 205 of 2013 under sections 147, 148, 149, 302, 364 IPC, P.S. Loni Katra, District Barabanki from local police to C.B.C.I.D..
From the perusal of the counter affidavit filed on behalf of State of U.P. it reveals that in the present case investigation has been completed and charge sheet dated 24.5.2014 has been submitted in the court of learned Magistrate concerned for the offence under section 304 IPC against Umesh @ Guddu Verma and Lallu Yadav. In such circumstances the relief sought may not e granted. But it is open to the petitoners to raise the objection against the charge sheet in the court concerned.
With the above observation, this petition is finally disposed of.
