JUDGMENT / ORDER

Petitioners are accused in Crime No.157 of 2014 of the Kunnamkulam Police Station for the offences punishable under Sections 143, 147, 148, 323, 324, 326, 308 r/w Section 149 of the Indian Penal Code, apprehend arrest and have filed the application.
2. Learned Public Prosecutor has opposed the application. It is submitted that on 16.01.2014 at about 09.45 p.m., the petitioners and others attacked the de facto complainant with sword, iron pipe, granite stone etc.
3. Learned counsel submits that the allegations are not true. It is submitted that Crime Nos.155 and 156 of 2014 are registered by the same Police for various offences for attacking persons belonging to the political party to which the petitioners belong. According to the learned counsel all these cases are interlinked and pre-arrest bail has been granted to some of the accused in Crime Nos.155 and 156 of 2014.
4. Learned Public Prosecutor has told me that though all the three incidents took place the same day, place and time B.A.No.3789 of 2014 2 of occurrence are different.
5. That, relief is granted to some of the accused in other cases is no ground to grant that relief in the present case. In the nature of allegation made, I do not find reason to grant pre-arrest bail. It is directed that in case the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of with the above direction.
