Heard learned counsel for the petitioners; the learned Standing Counsel for the State-respondents 3 to 5; and perused the record.
The present petition has been filed for a direction upon the 5th respondent (Tehsildar, Tehsil Sahjanwa, District Gorakhpur) to consider the claim of the petitioners in respect of updation of his voter Id card on the portal of Election Commission.
From the documents, which has been appended at page 21 of the paper book, it appears that voter Id card has been cancelled and in respect of restoration/updation of the voter Id card, request has been made to the Tehsildar.
Learned Standing Counsel has submitted that such request can appropriately be addressed by the District Election Officer and not by the Tehsildar and therefore the petitioners may make an appropriate representation before the concerned officer.
In view of the above, we deem it appropriate to dispose off this petition by giving liberty to the petitioners to move an application before the District Election Officer in respect of their grievance.
