Heard Sri Manoj Tripathi, learned counsel for the petitioner and Sri Zaid Arshad, learned counsel for respondent no.3 This writ petition has been filed by the petitioners to issue a writ, order or direction in the nature of certiorari quashing the impugned FIR dated 28.3.2019 registered as Case Crime No.0096 of 2019 under sections 323, 504, 506, 307 I.P.C, P.S.- Kiratpur, District- Bijnor.
It is an offshoot of a matrimonial dispute. Learned counsel for the petitioners states that parties are prepared for settlement by way of mediation and the petitioners at their own initiative, are willing and ready to deposit a sum of Rs. 50,000/- to demonstrate their bonafides, which is not resisted by Sri Zaid Arshad, learned counsel for the informant.
The matter is referred to Mediation and Conciliation Centre of this Court, wherein it will come up on 20.5.2019.
The petitioner no.3 shall deposit a sum of Rs.50,000/- by way of demand draft in the name of "Registrar General A/c, Allahabad High Court Mediation & Conciliation Centre", within three weeks from today before the Mediation Centre of this Court. The said amount shall be handed over to wife / victim (respondent no.3) before the Centre.
Respondents may file counter affidavit's within three weeks. Rejoinder affidavit, if any, may be filed within a week thereafter.
List in the week commencing 5.8.2019 before the appropriate Court.
Till the next date of listing, no coercive action shall be taken against the petitioners in the above referred case.
The Office shall issue certified copy of this order, only upon furnishing the proof of said deposit.
