(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) This is second application for extension of temporary bail which was extended by order dated 21.6.2012 initially granted by this Court by an order dated 18.5.2012.
No case is made out for grant of further extension. Hence, this application is rejected.
In earlier matter i.e. Criminal Misc. Application No.10507 of 2012, learned APP has tendered jail remarks; wherein, this convict i.e. Sachinkumar Nagindas Modi is shown to be in Mehsana jail as on 19.7.2012; whereas, factually it is incorrect because he is on temporary bail for last 2 months.
Learned APP to file affidavit of Deputy Jail Superintendent of Ahmedabad Central Jail under whose signature the jail remarks are tendered to this Court as to under what circumstances, this error has crept in. He shall further explain as to why contempt of criminal proceedings should not be drawn against him for filing incorrect fact before the Court.
Affidavit to be filed by 25th July, 2012, failing which, the Court will be compelled to pass coercive orders against Deputy Jail Superintendent.
Matter to be listed for only filing an affidavit on 25th July, 2012.
