Heard learned counsel for the petitioner and learned AGA for the State.
This writ petition has been filed by the petitioner with the prayer to quash the F.I.R. dated 15.06.2018, bearing Case Crime No.224 of 2018, under Section 363, 376, 323, 504 IPC and 3/4 POCSO Act and 3(1) SC/ST Act, police station Nai Mandi, DistrictMuzaffarngar, so far as it relates to the petitioner.
Pursuant to the earlier order dated 16.7.2018, learned counsel for the petitioner has filed supplementary affidavit annexing therein the statement of the prosecutrix recorded under Section 164 Cr.P.C., which shows that victim has supported the prosecution case.
From the perusal of the F.I.R. it appears that on the basis of the allegations made therein prima facie cognizable offence is made out hence, there is no scope for interfering with the impugned F.I.R.
Therefore, the prayer for quashing the impugned F. I. R. is refused. The writ petition is dismissed.
