Petitioners seek quashment of F.I.R. No.0338 dated 06.02.2020 lodged at Police Station Sihani Gate, District Ghaziabad for offences punishable under sections 452, 323, 504, 506 and 427 IPC.
The F.I.R. as evident is on the basis of complaint lodged by the complainant-respondent no.3 wherein it was stated that “हम लोग िकराये के मकान मे सनील जाटव िनवासी चमन कालोनी िसहानी थाना िसहानी गेट गािजयाबाद के यहॉ िकराऐ पर रहते है। मै मेहनत मजदरू ी कर अपने पिरवार का पालन पोषण कर रहा हूँ। मेरी सकू टी UP 14EC 1486 घर के बाहर गली मे खडी थी। इसी बात को लेकर पडोस मे रहने वाले सिचन पुत रामफल िनवासी चमन कालोनी थाना िसहानी गेट गािजयाबाद आया और मुझे व मेरे बचचो के साथ गाली गलौच कर मारपीट करने को तयार हो गया हमने ऐसा करने से मना िकया तो मेरी सकू टी उपरोक डडा मारकर तोड दी तथा सिचन वा उसकी माँ राके श दवी w/o रामफल तथा सिचन का जीजा सतराम पुत नामालुम िनवासी चमन कालोनी तीनो हमारे मकान मे अनदर घुस गये। मेरी पतनी सनील व मेरी पती सोनम के साथ गाली गलौच कर मारपीट की जसे तसे हम लोगो ने अपनी जान बची। ये लोग गुनडा िकसम के आदमी है। जाते-जाते भी जान से मारने की धमकी दकर गऐ। हमारे िरपोटर िलखकर हमे सुरका सहायता दने की कृ पा कर काननी कारवाई कर।े ”
Though it is contended on behalf of petitioners that petitioners are falsely implicated in the matter, however there is no cogent material brought on record to substantiate the contention that the petitioners are falsely implicated. It is also borne out from the submission made on behalf of petitioners that investigation is not completed, may be for the reason that petitioners are absconding.
In view whereof, we are not inclined to cause any indulgence in the matter.
Consequently, petition fails and is dismissed. No costs.
The relief sought by petitioners for pre-arrest bail also stands rejected.
