The petitioner seeks a writ of mandamus for expeditious disposal of the application moved by him on 16.2.2018 for grant of firearm licence on the ground of family heirloom policy.
The petitioner submits that the licence of the gun was in the name of his father and it was renewed upto 12.3.2012. The receipt of deposit of the gun in safe custody has also been brought on record.
Considering the said documents, without entering into the merits of claim of the petitioner, the present writ petition is being disposed of with the direction to the respondent no. 2 namely the District Magistrate, Allahabad/Licensing Authority to consider and decide the pending application dated 16.2.2018 of the petitioner, in accordance with law, expeditiously, preferably, within a period of three months from the date of submission of certified copy of this order, after seeking requisite reports.
It goes without saying that this Court has not entered into the merits of the claim made by the petitioner. The competent authority shall apply his own mind with the application independently and take a decision on merits.
