Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the summoning order dated 12.2.2013 as well as entire proceeding of complaint case no. 66 of 2013(Sarvesh Kumar Gupta Vs. Sachin Kumar under section 138 N.I. Act P.S. Tajganj district Agra pending in the court of Additional Court No. 1, Agra.
Learned counsel for the applicant has submitted that NBW, issued in the year 2017 and process drawn and continued upoto the year 2018. The learned counsel for the applicant straightway said the applicant is ready to deposit the amount provided some time may be given for participating in the proceedings of the courts below.
The applicant undertakes that he will participate in the proceedings and will not occasion delay in disposal of the case and that the applicant has expressed his desire to make payment of the amount involved in the case, if he is given some reasonable time, it is directed that in case the applicant appears before the court concerned within two weeks from today and moves an application for bail, the same shall be considered and disposed of by the court below expeditiously, if convenient on the same day.
For a period of two weeks from today, no coercive action shall be taken against the applicant.
It is made clear that in the event no such application is moved within the time prescribed above, this order will be of no avail to the applicant.
With the above direction, this instant application under section 382 Cr.P.C. is finally disposed of.
