This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Sachin Kumar Singh, in the event of his arrest in Case Crime No.180 of 2019, under sections 1417, 342, 448, 504, 506 I.P.C. & Section 7 of Criminal Law Amendment Act, Police Station- Kidwai Nagar, District- Kanpur Nagar.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It appears to be a very serious matter. About 20-25 persons in black commando dresses barged in the precincts of the first informant where the construction was going on. Thereafter with a brazen show of force by the accused all the precincts were locked and unlawful position was taken with sent waves of terror. The workers and officials were all kept under wrongful confinement. It was only after the interference of the local administration that the position was restored back and the locks were got broken. It appears that there has been a background of dispute with the accused and the first informant who has a land in the neighbourhood and regarding which some dispute is already going on and allegations have been made in that regard.
After considering the submissions advanced on behalf of rival sides, the nature and gravity of the accusation and the material in support of the same, and also keeping in view the criminal antecedents of the accused-applicant, I find no good ground for grant of anticipatory bail to the applicant.
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
