Heard Sri Jitendra Kumar, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner in the writ petition is seeking a direction to the respondents to get the land mafia dispossessed from his property. He is stated to have made an application before the District Magistrate, Kanpur Nagar, respondent no. 2, copy of which has been filed as annexure-1 to the writ petition, on which the District Magistrate is stated to have directed the SHO to examine the matter and get the order of the Commissioner complied. The order of the Commissioner dated 6.5.2016 is filed as annexure-4 to the writ petition which shows that he has directed Senior Superintendent of Police, Kanpur Nagar to inquiry into the matter and register a case against the guilty persons.
No useful purpose would be served by keeping this writ petition pending.
We dispose of the writ petition with a direction to the District Magistrate, Kanpur Nagar, respondent no. 2 to inquiry into the matter of the petitioner and take appropriate action in accordance with law in the light of the observations made above as well as his own previous order, annexure-1 to the writ petition, as well as the order of the Commissioner dated 6.5.2016, annexure-4 to the writ petition, expeditiously preferably within a period of three months from the date of receipt of a certified copy of this order in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
