Heard Sri Tripurari Pal, learned counsel for the petitioner, Sri N.K.Verma, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondents to arrest the respondent no.4 and other associate of respondent no.4 and also to direct respondents for fair investigation by another Investigating Agency in pursuance of the FIR dated 24.7.2018, registered as case crime No.290 of 2018, under Setions 147, 392, 323, 427, 341 I.P.C., P.S.Cantt., District Allahabad.
It has been contended by learned counsel for the petitioner that petitioner is the informant of the present case and he had lodged the present FIR against the respondent no.4 for the offence in question but the police instead of proceeding against against him in pursuance of the said FIR, has only challened him under Section 151 Cr.P.C., hence, the petitioner has come up before this Court with aforesaid prayer, as he apprehends that investigation is not being carried out in a fair and proper manner.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of two months from the date of production of a certified copy of this order.
It is further directed that the S.S.P., Allahabad shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
