Heard learned counsel for the applicant, Sri Ram Charan, Advocate, holding brief of Sri Pranjal Mehrotra, learned counsel for opposite party no.3, learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the impugned cognizance order dated 19.12.2018 passed by the Additional District and Session Judge-I, Amroha as well as charge sheet dated 4.4.2018 submitted by the Investigating Officer in Criminal Case No. 433 of 2018 (State vs. Sabir), arising out of Case Crime No. 64/2018 under Section 135 of Indian Electricity Act (Amendment) 2003, Police Station Hasanpur, District- J.P. Nagar, pending in the court of Additional District and Session Judge-I, Amroha.
Learned counsel for the applicant contended that the applicant has paid the entire money as electricity due/arrear Rs. 34,352/-, which includes the compounding amount as well, copy whereof has been placed on record as Annexure No.4 to the affidavit filed in support of this application.
Learned counsel for the opposite party No.3 also does not dispute the aforesaid submission of learned counsel for the applicant and he does not want to pursue the matter any further.
In view of above, obviously nothing remains due against the applicant, no useful purpose would be served in keeping the application pending.
Consequently, the proceedings in the aforesaid case is hereby quashed.
