The petitioner had admitted herself to the B.A. Economics in the year 2003. For various reasons she was unable to continue the same. Later on the year 2012-13, she sought for re-admission to the second year. She continued her studies for second year B.A during the academic year 2012-13 by registering as a private candidate and appeared for the examinations. She was also permitted to continue the third year as a private candidate and had appeared for the examinations. The result of the examinations qualified her to a graduate degree. However, the University has not issued the provisional certificate. The petitioner submits that she has now applied for the M.B.A course in the very same University and she needs a provisional certificate to get admission to the said course. W.P.(C) No.29967 of 2014 - U 2 The learned Standing Counsel for the University submits that the provisional certificate can be issued only after getting a decision from the Academic Council. In any event, since the petitioner has been permitted to appear for the examination after private study, in the year 2012-13 and 2013-14 and the petitioner has qualified in the B.A degree examination. The petitioner if seeks admission before any centre affiliated to the University shall be provisionally admitted on the basis of her mark lists, subject however, to the issuance of the degree certificate.
The writ petition is disposed of with the above directions. But, however, leaving all the contentions of the petitioners open. Mark lists of the petitioner shall be in any event, issued within a period of two weeks from today however, showing the issuance of a provisional certificate.
