Heard learned counsel for the petitioner and learned Standing Counsel. Shri R.C. Upadhyay appears for Gaon Sabha.
The petitioner is before this Court asking the third respondent to permit the petitioner to take out fishes from the pond in question by recalling the order dated 22.3.2017 to the extent the petitioner was restrained to take out fishes from the said pond.
Learned counsel for the petitioner states that for the redressal of his grievance he has made representation to SDM concerned on 27.12.2013 on which cognizance was taken on 22.3.2017 but since then no action has been taken on the said report and as such this Court should come for rescue and reprieve of the petitioner.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the SDM concerned to look into the grievance of the petitioner and pass appropriate order in accordance with law expeditiously and preferably within four weeks from the date of production of certified copy of this order.
