Heard learned counsel for the applicant and learned A.G.A. It is contended by the learned counsel for the applicant that the applicant is father in law of the son of O.P.No.2, the daughter of the applicant is married with the son of the O.P.No.2. From the applicant's side a complaint case No. 214 of 2006 under sections 323, 498-A, 504, 506 I.P.C.and ¾ D.P.Act has been filed and a case under section 125 is also pending against the O.P.No.2. In its counter blast, the FIR of this case has been lodged in which the charge sheet has been submitted. The learned A.G.A. prays for and is granted four weeks time to file counter affidavit.
Issue notice to O.P. 2 returnable within a period of four weeks. In view of the submissions made by the learned counsel for the applicant and the learned A.G.A. further proceedings in case no. 3156 of 2007 under sections 323, 504, 506 I.P.C. , P.S. Jigna, District Mirzapur , pending in the court of learned Chief Judicial Magistrate, Mirzapur shall remain stayed till the next date of listing. List after four weeks for orders.
