Heard learned counsel for the petitioner and Sri Deepak Kumar Singh, State Law Officer.
The petitioner claims to be fair price shop agent of Gram Panchayat Juthiya Block Chamraua Tehsil Sadar, District Rampur. The licence of the petitioner has been suspended by respondent no.2 by order dated 10.05.2019 which is impugned in the present petition.
Learned counsel for the petitioner after arguing the matter at some length submits that the petitioner shall file the reply against the charges levelled again him in the suspension order within two weeks and enquiry against the him shall be concluded within the time bound period.
State Law Officer submits that no useful purpose would be served in keeping the writ petition pending.
Be that as it may, Section 8(8) of The Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 (hereinafter referred to as 'Order 2016') provides that the competent authority shall conclude the enquiry within a period of two months from the date of initiation of proceeding. Therefore, considering the facts and circumstances of the case and without adverting anything on the merit and with the consent of the parties, it is provided that in case petitioner submits his reply to the charges levelled against him in the suspension order within a period of two weeks from today, the respondent no.2 shall conclude the same within the period stipulated in Section 8(8) of Order, 2016, if there is no other legal impediment in concluding the enquiry. .
The writ petition is disposed off.
