JUDGMENT / ORDER

Heard the learned counsel for the applicants and learned A.G.A. for the State as well as perused the documents available on the record.
The accused-applicants Sabbeer and Waseem are involved and detained in Case Crime No. 51 of 2010, under Sections 147,148, 149, 307 I.P.C., from Police Station Lalganj Kotwali, District Pratapgarh and they have applied for bail.
The submission of the learned counsel for the accused applicants is that co-accused Mohd. Akhtar, Mubeen and Ishraar have already been ordered to be released on bail. As per version of the F.I.R., the role of present accused applicant is identical as the role of co-accused who have already been ordered to be released on bail. Moreover, there are cross cases between the parties and both sides had sustained fire-arm injuries. Therefore, accused applicants also deserve to be released on bail.
Learned A.G.A. although opposed the bail application but fairly accepts that the co-accused having similar role as against the present accused applicants have already been ordered to be released on bail.
Considered the submissions of the learned counsel for the accused applicants and the learned A.G.A.
Keeping in view the totality of the facts and circumstances of the case as well as the fact that the co-accused having similar role as against the present accused applicants have already been ordered to be released on bail, without expressing any opinion on the merit of the case, the accused applicants may also be released on bail.
Let applicants Sabbeer and Waseem be released on bail in the aforesaid case crime number on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
