Sri N.K.Singh who is appearing for the petitioner submits that the petitioner is the plaintiff in suit no 26/2013 Sabaraun Nisha Vs Gulbadan and the said suit is pending before the learned Civil Judge (SD) Kushinagar at Pdarauna. He further submits that till date the suit is stuck at the stage of filing of written statement. To substantiate his submission, he relies upon the order sheet which is annexed as annexure 2 to the petition.
Considered the submissions and perused the record.
Considering the judgment of the Supreme Court in M/S Shiv Cotex Vs Tirgun Auto Plast P Ltd andothers 2011 (89) ALR 232, the trial court is directed to expedite the suit and decide it finally within a period not exceeding six months from today in accordance with law. The trial court shall ensure that no unnecessary adjournments are granted in the matter.
The petition is disposed of accordingly in terms of the above.
