Proceedings for maintenance filed under Section 125 CrPC by the wife who is the applicant here registered as Case No.46 of 2018 (Sabita Vs. Basant Lal) on the file of the learned Addtional Sessions Judge/Fast Track Court-II, Jaunpur.
The proceedings are still young but, however, inherent urgency is involved in this matter as the wife has no means of sustenance and the purpose of the proceedings is to prevent destitution and provide support to the wife.
Looking to the aforesaid facts and circumstances, it is directed that the learned Additional Sessions Judge/Fast Track Court-II, Jaunpur shall proceed to decide Case No.46 of 2018 within a period of eight months next, unless there be any legal impediment.
In case an application for interim maintenance is filed the same shall be disposed of within one month from the date the same being filed.
This order will, however, not operate if there is an order of stay by the Court of a Superior Jurisdiction.
This application is disposed of with the above orders.
