Challenge in the writ petition is to an order passed against the petitioner expunging his name. This order has been passed exercising the powers conferred under Section 38 of the U.P.Revenue Code,2006.
Against the order impugned, the petitioner has a statutory alternative remedy of an appeal.
However, it has been submitted that the writ petition is maintainable as the order has been passed exparte.
However, looking into the facts and circumstances of the case, this writ petition is disposed of with the following observations/ directions:
In case, the petitioner prefers an appeal against the order impugned within a period of 10 days from today, annexing thereto, all such evidence that he proposes to rely upon, the appellate authority shall consider the appeal as also the evidence of the petitioner and dispose of the same by a reasoned and speaking order within a period of eight weeks, thereafter.
