S vs State

High Court Of Gujarat|30 April, 2012

JUDGMENT / ORDER

Heard Mr. Sojitra, learned advocate for the petitioners, and Mr. Ashar, learned AGP, for the respondent - State.
2. Under order dated 20.4.2012, the office was directed to issue notice, returnable on 30.4.2012. It is noticed that though the service was effected, any reply to the petition, has not been filed by the respondents.
3. Learned advocate for the petitioners has also relied on several orders passed in previous round of litigation. It appears that the petitioners are being denied various benefits available to regular employees, only on the ground that they are ad-hoc employees and have not been recruited, after following due procedure. The petitioners have claimed that in view of the orders passed in other group of petitions, some of the benefits have been granted to certain employees, who came to be engaged after the date on which present petitioners were engaged.
4. On overall consideration of the facts, it, prima-facie, appears that the claim made by the petitioners deserves consideration. Therefore, below mentioned order is passed.
4.1 RULE.
4.2 The respondents may file reply affidavit, as early as possible, preferably by 31.7.2012.
