This bail application has been moved on behalf of the applicant- Sita seeking bail in Case Crime No. 411 of 2013, under Sections 498A, 304B, 302 I.P.C. and 3/4 Dowry Prohibition Act, Police Station Behat, District Saharanpur.
Allegation against the applicant is that she has killed her daughter-in-law as well as her son.
It is contended on behalf of the applicant that son of the applicant had some mental disorder. In support of the said submission learned counsel for the applicant has drawn my attention to annexure-6 of the affidavit, which is medial prescription for treatment of her son. It is stated that son of the applicant has killed his wife due to insanity and thereafter he committed suicide by hanging himself. The applicant is aged about 69 years old and is in jail since 03rd December, 2013.
I have heard learned counsel for the applicant and learned A.G.A. and perused the record.
Having regard to the fact that the applicant has been implicated for murder of her daughter-in-law and her son, who had some mental disorder and who hanged himself, I am of the view that the applicant is entitled for bail.
Let the applicant- Sita involved in Case Crime No. 411 of 2013, under Sections 498A, 304B, 302 I.P.C. and 3/4 Dowry Prohibition Act, Police Station Behat, District Saharanpur be released on bail on her executing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned, on the following conditions:
(1) The applicant will not make any attempt to tamper with the prosecution evidence in any manner whatsoever.
(2) The applicant will personally appear on each and every date in the Court and her personal presence shall not be exempted unless the Court itself deems it fit to do so in the interest of justice.
Accordingly, the bail application is allowed.
