JUDGMENT / ORDER

The petitioner has filed the present petition seeking to withdraw the M.C.No.11 of 2017 from the file of the Family Court at Salem and transfer the same to the file of the Additional District and Sessions Judge at Virudhachalam, where H.M.O.P.133 of 2017 and H.M.O.P.109 of 2017 have now been transferred by the orders of this Court dated 15.06.2017.
2. The learned counsel for the petitioner submitted that the maintenance case filed by the respondent/wife is pending before the Family Court at Salem. The learned counsel also submitted that since the petitioner is a bank employee and could not get leave every month to attend the court, he prays for transfer of the maintenance case, filed by the respondent/wife to be transferred to Additional District and Sessions Judge at Virudhachalam, where H.M.O.P.133 of 2017, filed by the petitioner/husband and H.M.O.P.109 of 2017, filed by respondent/wife have already been transferred by the orders of this Court dated 15.06.2017.
3. The learned counsel appearing for the respondent submitted that the respondent has no objection to transfer the maintenance case filed by her to the Additional District and Sessions Judge at Virudhachalam.
4. In view of the above, the maintenance case , filed by the respondent in M.C.No.11/2017 is ordered to be withdrawn from the file of Family Court, Salem and the same is transferred to Additional District and Sessions Judge at Virudhachalam. The Family Court, Salem is directed to transmit all the records pertaining to M.C.No.11/2017 to the file of Additional District and Sessions Judge, Virudhachalam within a period of two weeks from the date of receipt of a copy of this order. With the above direction, the criminal original petition is disposed of. Consequently, connected Crl.M.P is closed.
